Introduction<\/h2><p>Visits to the website of Fundaci\u00f3n Deportiva Municipal de Val\u00e8ncia (hereinafter, OA FDM) are initially anonymous.<\/p><p>In order to access any of the website&#8217;s services that require specific management or processing, users must provide the personal data necessary for the provision of the requested service.<\/p><p>This data will be incorporated into the corresponding processing activities of OA FDM and will be processed for the specific purpose of each processing operation, in accordance, mainly, with the regulations established by Regulation (EU) 2016\/679 of the European Parliament and of the Council, of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (General Data Protection Regulation) and Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD).<\/p><p>The Portal owned by OA FDM contains links to third-party websites, whose privacy policies are unrelated to that of OA FDM. When accessing such websites, you can decide whether to accept their privacy and cookie policies. In general, when browsing the internet, you can accept or reject third-party cookies from your browser settings.<\/p><h2>II. General information on privacy and data protection<\/h2><p>Below, OA FDM provides general information about the safeguarding of privacy and the protection of personal data applied to the processing activities it carries out on the Portal, as well as by other means:<\/p><h3 style=\"color: #800080;\">1. Who is responsible for processing your personal data?<\/h3><p>OA FDM is the Data Controller, advised and supervised by our Data Protection Officer: dpd@fdmvalencia.es<\/p><h3 style=\"color: #800080;\">2. Why do we process your personal data?<\/h3><p>The data provided to us, as well as any other data generated during the course of our relationship with the citizen\/interested party, may be processed for different purposes depending on the services provided and, in any case, to maintain contact and communication with them and to manage the provision of services requested\/provided by OA FDM.<\/p><p>Your personal data collected will be processed for the following purposes:<\/p><ul><li>Management of activities and events organised by OAM FDM.<\/li><li>Communication with participants and management of registrations.<\/li><li>Compliance with legal and administrative obligations.<\/li><li>Processing of personal data for registration in the Gay Games Valencia XII, managed by the Gay Games Federation.<\/li><li>Management of merchandise sales and donation processing: Order processing, product shipping, accounting and administrative tasks, and issuance of donation receipts as needed.<\/li><\/ul><p>Where applicable, more explicit and specific purposes may be indicated in the information clauses included in each of the data collection channels (web forms, paper forms, announcements or posters and information notes) for specific cases.<\/p><p>In any case, you can consult the record of personal data processing activities carried out by OA FDM in order to find out the specific uses or purposes of each personal data processing operation. <a href=\"http:\/\/www.fdmvalencia.es\/wp-content\/uploads\/2024\/10\/RAT_registro_act_tratamiento_2024.pdf\" target=\"_blank\" rel=\"noopener\">Consult the Record of Personal Data Processing Activities.<\/a><\/p><h3 style=\"color: #800080;\">3. What is the legal basis that legitimises the processing of your personal data? In other words, what is the basis or justification for us to process your personal data?<\/h3><p>The legal basis that legitimises our processing of your data may vary: (i) normally, in the public sector, the legitimacy lies in the need to comply with a legal obligation, a mission carried out in the public interest or in the exercise of the public powers or competences granted to OA FDM; (ii) and, where applicable, the performance of a contract to which you as a contractor or successful tenderer, such as the consent that may have been required for the processing of your personal data.<\/p><p>The provision of the data we request is mandatory because it is essential for us to respond to your request or provide our services; if you do not provide it, we will not be able to respond to your request or provide our services.<\/p><p>In the event that the processing is based on your consent, it will be understood to have been given unequivocally, with the provision of the data being considered a clear affirmative act on your part, expressing such consent.<\/p><p>In the case of the processing of your personal data by the Gay Games Federation, such processing will be carried out with the consent of the participant when registering for the event.<\/p><p>If you provide personal data of other individuals, you must respect their privacy. Only the owner of the data can authorise the processing of their personal data. You will be entitled to process the personal data of other individuals if you act as their legal or voluntary representative or if, with their knowledge, the data is transmitted for the purpose of reporting or claiming rights against them.<\/p><p>The publication of third-party data without their consent may infringe not only data protection regulations but also those relating to the right to honour, privacy or the image of those third parties.<\/p><h3 style=\"color: #800080;\">4. How long do we keep your personal data?<\/h3><p>In general, we will keep the personal data provided to us in order to maintain a service history and manage our services efficiently, unless the data subject requests its deletion. Even if deletion is requested, the data will remain blocked for as long as necessary, and its processing will be limited to only one of the following cases: to comply with any legal\/contractual obligations to which we are subject and\/or during the legal periods established for the limitation of any liabilities on our part and\/or the exercise or defence of claims arising from the relationship with the citizen\/data subject.<\/p><p>In any case, you can obtain more information, depending on the personal data processing activity in question, in our <a href=\"http:\/\/www.fdmvalencia.es\/wp-content\/uploads\/2024\/10\/RAT_registro_act_tratamiento_2024.pdf\" target=\"_blank\" rel=\"noopener\">Register of Personal Data Processing Activities.<\/a><\/p><h3 style=\"color: #800080;\">5. Who may be the assignees or recipients of your personal data?<\/h3><p>The data you provide may be transferred or communicated to public or private entities to which the transfer is mandatory or necessary for the achievement of specific and legitimate purposes.<\/p><p>For the proper management of registrations for the Gay Games Valencia XII, the personal data entered in the registration form on the website will be processed directly by the Gay Games Federation, the event organiser.<\/p><p>In this regard, the OA FDM will not be responsible for the processing of this data once it has been transferred to the Gay Games Federation, which will act as an independent entity in accordance with its own privacy policy.<\/p><p>Please be advised that the Gay Games Federation is located in the United States (U.S.). The European Union has not issued an adequacy decision for this country, and the federation is not a signatory to the Data Privacy Framework; therefore, there are no adequate safeguards in accordance with the provisions of the GDPR. This means that your data may not enjoy a level of protection equivalent to that provided in Europe.<\/p><p>We recommend that you review their privacy policy beforehand: <a href=\"https:\/\/www.gaygames.org\/privacy-policy\" target=\"_blank\" rel=\"noopener\">https:\/\/www.gaygames.org\/privacy-policy<\/a>.<\/p><p>Consequently, the registration form will request your explicit consent for this international transfer, in accordance with Article 49.1(a) of the GDPR. Personal data security<\/h3><p>In accordance with the First Additional Provision of Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights, the security, technical and organisational measures adopted by OA FDM and intended to safeguard the confidentiality and protection of personal data, preventing its loss, alteration or unauthorised access, are those established in Annex II of Royal Decree 3\/2010, of 8 January, regulating the National Security Scheme in the field of Electronic Administration (ENS).<\/p><p>The Gay Games Federation will be responsible for applying its own security measures with regard to the data it manages.<\/p><h3 style=\"color: #800080;\">7. What are your data protection rights and how can you exercise them?<\/h3><p>You may exercise your rights of access, rectification, erasure, restriction or, where applicable, objection. To do so, you must submit a written request to the Fundaci\u00f3n Deportiva Municipal de Val\u00e8ncia, Paseo de la Petxina, No. 42, Valencia (46008). In the letter, you must specify which of these rights you are requesting to be exercised and, in turn, you must show or, in the case of postal delivery, enclose a photocopy of your ID card or equivalent identification document. If you are acting through a legal or voluntary representative, you must also provide a document proving their representation and their identification document. Likewise, if you consider that your right to personal data protection has been violated, you may file a complaint with our Data Protection Officer (dpd@fdmvalencia.es) or, where appropriate, with the FDM?<\/strong><br \/>You, as the data subject or owner of the personal data, acting on your own behalf and in your own right.<\/p><p>Through another person acting as your duly accredited legal representative (e.g. when parents or guardians act on behalf of a person under the age of 14 or when acting as the legal representative of a person with functional diversity) or volunteer (a person to whom you have freely and voluntarily granted powers of representation for this purpose).<\/p><p><strong>c) How and where can I exercise these rights?<\/strong><br \/>You can submit your request through the Registry Office, by post to Fundaci\u00f3n Deportiva Municipal de Val\u00e8ncia, Paseo de la Petxina, No. 42, Valencia (46008) or by email to: dpd@fdmvalencia.es.<\/p><p>You must:<\/p><ul><li>Provide sufficient data and information to process the request. For this purpose, you may use the form templates provided by the Spanish Data Protection Agency https:\/\/www.aepd.es\/es\/derechos-y-deberes\/conoce-tus-derechos<\/li><li>Sign the form by hand or, if applicable and if you have a recognised digital certificate, sign it electronically.<\/li><li>Attach a photocopy of your ID card, passport, foreigner identification number (NIE) or other equivalent identification document. If you are acting on behalf of a third party, you must also include a copy of their ID card or equivalent identification document, as well as the document proving that you represent the interested party.<\/li><li>Send the form and documents proving your identity by any of the means mentioned above.<\/li><\/ul><p><strong>d) Additional information<\/strong><br \/>OA FDM will analyse whether or not the request complies with the law. It will notify the petitioner of the decision taken and proceed accordingly: if the request is granted, it will take the appropriate measures in accordance with the right exercised; if the request is rejected, it will indicate the legally established appeals system. Specific information on the use of surveillance cameras or video cameras by OA FDM<\/h2><h3 style=\"color: #800080;\">Video surveillance in buildings and facilities<\/h3><p>In order to ensure the safety of property, facilities, and premises, as well as of the people who work there or have access to them, OA FDM announces that it has installed surveillance cameras. This measure is intended to serve as a proactive and preventive step against potential risks, hazards, or violations that could affect people, property, and facilities.<\/p><p>The images captured by the video surveillance systems are processed by OA FDM as the data controller.<\/p><p>The lawfulness of the processing is based on Article 6.1.e) of the GDPR: the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller, pursuant to Organic Law 4\/2015 of March 30 on the protection of public safety.<\/p><p>The images (personal data) will be retained for a maximum period of one month, unless they must be preserved for submission to the competent public authorities in the event that unlawful or irregular acts have been captured. Thus, the images may be provided, where appropriate, to law enforcement agencies, as well as to courts or tribunals.<\/p><p><strong>Note<\/strong>: To exercise your right to access or delete images of yourself [or, if applicable, of the person you represent], you must provide [in addition to the information mentioned above regarding the exercise of these rights] a recent photograph so that you can be identified, if necessary, in the recorded images. You must also indicate, as precisely as possible, the date(s), time(s), and location(s) where you were allegedly recorded.<\/p><h2>IV. Information on the Publication of Images, Matches, and Sports Results from the 2026 Valencia Gay Games<\/h2><p>The 2026 Gay Games Valencia will generate a large amount of visual and sports-related content. In this section, the FDM Organizing Committee explains how we handle images and data related to matchups and competition results. Our goal is to ensure that anyone participating in or attending the event knows what is being published, why it is being published, and where they can exercise their data protection rights.<\/p><h3 style=\"color: #800080;\">1. Who is the data controller?<\/h3><p>The OA FDM is responsible for processing the images and sports information published on this official website.<\/p><h3 style=\"color: #800080;\">2. Why are sports images and results published?<\/h3><p>The 2026 Valencia Gay Games are a sporting and cultural event of public interest, with an international reach and a clear commitment to outreach. As a co-organizer of the event, we have a responsibility to adequately communicate the event\u2019s progress, its competitions, and its results.<br \/>For this reason, we are publishing:<\/p><ul><li>Images documenting the event.<\/li><li>Matchups, schedules, and sports results.<\/li><\/ul><p>All of this is done for informational and transparency purposes, as is appropriate for an event of this nature.<\/p><h3 style=\"color: #800080;\">3. What kinds of images might appear on the website<\/h3><p>During the event, photos and videos will be taken in various locations: competition areas, ceremonies, common areas, and official activities. The following may appear on the website:<\/p><ul><li>General shots of the event atmosphere.<\/li><li>Photos of participants during the competition or at official events.<\/li><li>Images of volunteers and accredited staff performing their duties.<\/li><li>Photos of the audience when they are part of the general setting and not the main focus.<\/li><\/ul><p>When an image clearly shows a person in close-up and is not related to the sporting activity or event coverage, we will ask for your consent before publishing it. For future promotional uses (posters, campaigns, corporate videos, etc.), we will also request your express consent.<\/p><h3 style=\"color: #800080;\">4. Publication of matchups and sports results<\/h3><p>The event website will provide the information needed to follow the competitions:<\/p><ul><li>Scheduled matches.<\/li><li>Schedules and timetables.<\/li><li>Official results.<\/li><\/ul><p>To avoid unnecessary exposure of personal data, this information will be presented in a structured format with certain limitations:<\/p><ul><li>Matchups and results will be available through searches by sport, avoiding massive lists that include all participants.<\/li><li>Only data strictly necessary to identify athletic participation will be published: first name, last name, club (if applicable), category, and result.<\/li><li>Contact information or any information that could be considered sensitive will not be published.<\/li><\/ul><h3 style=\"color: #800080;\">5. How we protect published information<\/h3><p>For both images and sports results, we implement measures to limit public exposure and prevent misuse:<\/p><ul><li>We carefully select the images we publish, avoiding those that may be intrusive or reveal particularly sensitive information.<\/li><li>We limit how results are displayed, prioritizing individual search systems by modality.<\/li><li>We reduce search engine indexing for content that does not require mass dissemination.<\/li><li>We publish images at resolutions that make unauthorized reuse difficult.<\/li><li>We periodically review published content to remove material that is no longer necessary.<\/li><\/ul><h3 style=\"color: #800080;\">6. How long are the images and results retained?<\/h3><p>The images and sports results will be retained only for as long as necessary to fulfill the event\u2019s informational purposes. Once the broadcast period has ended, they will be removed or archived in such a way that individuals cannot be identified, unless there is a legal obligation or public interest that justifies their retention.<\/p><h3 style=\"color: #800080;\">7. Data protection rights<\/h3><p>Any person who appears in an image or whose sports-related data is published may request:<\/p><ul><li>Access to the information concerning them.<\/li><li>The removal of an image in which they appear in an identifiable manner.<\/li><li>The correction of inaccurate sports-related data.<\/li><li>The restriction or erasure of the processing where appropriate.<\/li><\/ul><p>Requests may be sent to the Data Protection Officer\u2019s email address as indicated in Section II.7, \u201cWhat are your data protection rights and how can you exercise them?\u201d We will address each request individually and in a reasoned manner, taking into account the public interest of the event and the rights of the requesting individual.<\/p><h3 style=\"color: #800080;\">8. Pre-event and during-event information<\/h3><p>Before and during the 2026 Valencia Gay Games, participants, volunteers, and attendees will be informed that photographs and video recordings will be taken and that the competition results will be published.
