OA FDM hereby informs you of the General Terms and Conditions governing access, browsing and use of the Internet Portal. \u00a0<\/span><\/p>

OA FDM may, at any time and without prior notice, modify the General Terms and Conditions of Use, as well as, where appropriate, the Specific Conditions, which may be established.\u00a0 <\/span>For this reason, it is recommended that before starting to browse, you read this ‘Legal Notice’ carefully.<\/span><\/p>

Nature of the information published on the Portal or website<\/span><\/h2>

The information provided on this website is for illustrative purposes only and does not give rise to any rights or expectations of rights and no liability is accepted for content accessible via links or documents on other domains.<\/span><\/p>

OA FDM endeavours to ensure that this information is accurate and precise, and updates it as quickly as possible, trying to avoid errors and correcting them as soon as they are detected. General terms and conditions of use of the Portal<\/span><\/h2>

By accessing and browsing the OA FDM Internet Portal and\/or by using the services included therein, you acquire the status of User, without reservations of any kind, to each and every one of these General Terms and Conditions of Use and the Specific Conditions, which, where applicable, govern the provision of the services available on the Portal or website, without prejudice to the attention and compliance by the User of the conditions set and provided for by the websites linked or hyperlinked from https:\/\/www.fdmvalencia.es\/es\/, for which OA FDM is not responsible.<\/span><\/p>

In any case, the User undertakes to make appropriate use of the content and services that OA FDM offers through the Portal; and, by way of example, but not limitation:<\/span><\/p>

  1. Not to engage in activities that are unlawful, illegal or contrary to good faith and public order.<\/span><\/li>
  2. Not to introduce, store or disseminate on or from the Portal any information or material that, explicitly or implicitly, is defamatory, libellous, offensive, obscene, threatening, xenophobic, in defence of terrorism, pornographic or incites to violence, discrimination on grounds of race, sex, ideology, religion or that in any way violates morality, public order, fundamental rights, public freedoms, with special attention to the honour, privacy or image of third parties and, in general, human rights.<\/span><\/li>
  3. Not to use false identities or impersonate the identity of others in the use of the Portal or in the use of any of the services provided, including the use of passwords or access codes of third parties or in any other way. <\/span>Consequently, the User may not attempt to access and, where appropriate, use the passwords of other users and modify or manipulate their messages.<\/span><\/li>
  4.   5. Not to destroy, alter, use for use, render useless or damage the data, information, programmes or electronic documents of OA FDM or any third party.<\/span><\/li>
  6. Not to introduce, store or disseminate through the Portal any content that infringes the intellectual or industrial property rights or business secrets of third parties, or in general any content of which it does not hold, in accordance with the law, the right to make it available to third parties.<\/span><\/li>
  7. Not to use the services offered on the Portal for the purpose of promoting external companies and services, other websites and advertising or commercial campaigns, or to act for the benefit of legal entities.<\/span><\/li><\/ol>

    In the event of contravention of the above conditions, OA FDM reserves the right and will be entitled to block, suspend or cancel, immediately and without prior notice, access to and use of the Portal and, where appropriate, to remove alleged or declared illegal content, whether it does so at its sole discretion, and at the request of the third party concerned or of the competent authority.<\/span><\/p>

    Responsibility<\/span><\/h2>

    OA FDM accepts no liability for any damages that may arise from, by way of example and without limitation:<\/span><\/p>

    1. Inferences, omissions, interruptions, computer viruses, breakdowns and\/or disconnections in the operational functioning of this electronic system or in the computer apparatus and equipment of the Users, caused by causes beyond the control of OA FDM, which prevent or delay the provision of the services or browsing of the System.<\/span><\/li>
    2. Delays or blockages in use caused by deficiencies or overloading of the Internet or other electronic systems.<\/span><\/li>
    3. Unlawful interference that may be caused by third parties outside the control of OA FDM.<\/span><\/li>
    4. The impossibility of providing the service or allowing access for reasons not attributable to OA FDM, due to the User, third parties, or force majeure.<\/span><\/li>
    5. The OA FDM Portal may contain links to the electronic sites of other public administrations or to the web pages of other bodies, companies or institutions, with the aim of making it easier for citizens to find information and resources via the Internet. However, these pages are not owned by OA FDM and, therefore, OA FDM is not responsible for their content, operation or any possible consequences that may arise from accessing or using them. <\/span><\/li><\/ol>

      Intellectual and industrial property<\/span><\/h2>

      All the elements of the Portal (including, but not limited to, source codes, databases, design, images, photographs, drawings, graphics, animations, applications, search engines, pages, logos, trademarks and trade names) are the property of OA FDM or have been assigned to it (unless not expressly indicated). Therefore, the rights of authorship and exploitation to the full extent and in all their forms are protected by national and international intellectual and industrial property laws, the infringement of which constitutes an illegal and criminal activity.<\/span><\/p>

      In particular, but without limiting the user’s obligation expressed in the previous section, the reproduction, transformation, distribution, public communication and in general any other form of exploitation, by any procedure, of all or part of the contents of this portal, as well as its design, methods of selection or forms of presentation of the resources and materials included in it, are prohibited.<\/span><\/p>

      Reproduction (printing and downloading) of extracts from the contents of the Portal or website is authorised only for personal or private use, or for research or study purposes.<\/span><\/p>

      Re-use of public sector information<\/span><\/h2>

      Pursuant to Article 8 of Law 37\/2007 of 16 November 2007 on the re-use of public sector information, the re-use of information from public administrations and public sector bodies shall be subject, inter alia, to the following general conditions:<\/span><\/p>

      1. That the content of the information is not altered.<\/span><\/li>
      2. The meaning of the information is not distorted.<\/span><\/li>
      3. That the source is acknowledged<\/span><\/li>
      4. The date of the last update of the documents subject to re-use is mentioned, provided that it was included in the original document.<\/span><\/li>
      5. It shall not indicate, imply or suggest that the information to be re-used is sponsored or supported by the re-use of the information.<\/span><\/li>
      6. Retain and not alter or delete metadata on the date of update and applicable conditions for re-use included, where applicable, in the document made available for re-use.<\/span><\/li><\/ol>

        The use of the data sets, made openly available, shall be made by the users or re-use agents at their own risk, and they alone shall be liable to third parties for any damage arising therefrom.<\/span><\/p>

        However, exceptionally and with reasons given, FDM may choose to apply the modalities provided for in paragraphs b) and c) of article 4.2 of Law 37\/2007, of 16 November, on the re-use of public sector information:<\/span><\/p>
